Child Support
One of the basic public policies of the State of Florida
is to require a parent to provide support for his or her child(ren). Child support
is a right that belongs to the chid(ren) and as such, even the parents cannot agree to waive a party's child support obligation. Naturally, both parents have a duty and obligation to support their child(ren). In consideration of that, child support guidelines have been established by Florida statutes. The parents' gross incomes, their lawful deductions, their individual health insurance costs, the health insurance costs for the child(ren) and any applicable child care costs an~ all factored into determining the amount of child support. In addition, the amount of timesharing, which was previously and commonly known as child custody/visitation
that each parent is entitled to is also an important element of the child support guidelines. The amount of child support calculated by the guidelines is deemed presumptively correct and cannot be modified more than 5% up or down without the court making specific findings of fact indicating why ordering the payment of guidelines child support would be unjust or inappropriate.
